What is a Power of Attorney?
A Power of Attorney is a legal document where you appoint another person, called an attorney, to make legal and financial decisions on your behalf, such as banking or selling real estate that you own.
The Power of Attorney Act requires that a designated attorney must be at least 19 years of age.
Power of Attorney allows you to appoint a person such as a family member, relative or trusted friend to manage your legal and financial affairs for you. One reason a person might choose to appoint a power of attorney is in the event that he or she will be away from home temporarily or for a longer period of time.
What is Enduring Power of Attorney?
Enduring Power of Attorney goes beyond a “regular” Power of Attorney in that the Attorney you appoint will be able to make legal and financial decisions on your behalf even if you are no longer capable of making these decisions. When you are incapacitated, due to disability or illness, important financial and legal decisions must be made on your behalf. You have the option, while you are still capable, to appoint a trusted individual to act in your stead in the event you are unable to speak for yourself.

- can start only in the event when you lose capacity
